RI Personal Injury Attorney

RI Personal Injury LawyerRhode Island personal injury lawyers are licensed to represent clients in all types of negligence causes of action ranging from medical malpractice, workers compensation to your standard rear end Providence Car accident. There is no special license required for Personal Injury Lawyers in RI to handle complex matters such as Social Security Disability (ssi/ ssdi) to complex product liability claims.

The Rhode Island Supreme Court sitting in the Capital City of Providence made it abundantly clear that they are not going to require certifications for a RI Personal injury Attorney to represent clients in negligence claims in RI. This means that a RI Auto Accident Lawyer is also qualified to represent a client in a pedestrian accident, bus accident, bicycle crash or truck collision case.

Despite the fact that Rhode Island Personal injury Attorneys are legally allowed to handle claims such as wrongful death, car crash claims, premises liability and slip and fall lawsuits, it is important to retain a RI lawyer who is experienced in handling the type of Matter that you are seeking legal help for.

Here is a sample of the type of wording that the Top Court in Rhode Island and Providence Plantations requires lawyers to put on certain advertising: ‘The Rhode Island Supreme Court licenses all lawyers and attorneys in the general practice of law, but does not license or certify any lawyer / attorney as an expert or specialist in any field of practice’

Many states have different rules concerning specialization. For example, Arizona has a certification process for workers compensation and personal injury. The Arizona Bar rules state: “No lawyer shall be required to be certified as specializing in personal injury and wrongful death before that lawyer can practice law in the field of personal injury and wrongful death or act as counsel in any particular type of personal injury and wrongful death matter. Any lawyer, alone or in association with another lawyer, shall have the right to practice in the field of personal injury and wrongful death and to act as counsel in every type of personal injury and wrongful death case, even if the lawyer is not certified as specializing in personal injury and wrongful death. www.azbar.org/media/93758/personal_injury_standards.pdf

According to wikipedia “A personal injury lawyer is a lawyer who provides legal representation to those who claim to have been injured, physically or psychologically, as a result of the negligence or wrongdoing of another person, company, government agency, or other entity. Thus, personal injury lawyers tend to be especially knowledgeable and have more experience with regard to the area of law known as tort law, which includes civil wrongs and economic or non-economic damages to a person’s property, reputation, or rights. Even though personal injury lawyers are trained and licensed to practice virtually any field of law, they generally only handle cases that fall under tort law including, but not limited to: work injuries, automobile and other accidents, defective products, medical mistakes, slip and fallaccidents, and more.” http://en.wikipedia.org/wiki/Personal_injury_lawyer

Editor’s notes on Pedestrian accident and yielding the right of way
The primary law pertaining to vehicular travel and pedestrian travel in RI intersections is set forth here: http://webserver.rilin.state.ri.us/Statutes/TITLE31/31-13/31-13-6.HTM
Motor vehicles with a green light at an intersection attempting a right or left turn“….shall yield the right-of-way to: (I) Pedestrians lawfully within an associated crosswalk; and (II) Other vehicles lawfully within the intersection.”
Under RI law cars are not required to yield a right of way to a pedestrian when they have a green light and passing straight through an intersection.

While this firm maintains joint responsibility, most cases of this type are referred to other attorneys for principle responsibility.
